Privacy Policy

Our Company operates  as and Peter Fothergill is the data controllers for this business.  This page informs you of my policies regarding the collection, use and Disclosure of Personal Information we receive from users of our site, Facebook page, Instagram pages and Online Gallery.  This information may also be provided by you to us via email or over the phone.

Information Collection and Use - During our communications, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you.  Personally identifiable ("Personal Information") can include your name, address,  names and ages of your children.  In order that we may conduct business with you we will also require a contact telephone number, email address, information regarding how you came to find us, details of any other clients that you may have referred to us and we will of course, hold photographs of you.

This Personal Information will be used to help us to provide the best service possible to you and in doing so, we may be required to share this information with our suppliers and Bank. 

As a freelance news photographer, I regularly provide content for Reach PLC to ensure that a reporter can contact you for further comment to a story or to ensure your name is correct on images used for local or national publications. You can read their Privacy Policy here.

An important part of growing our business comes from being able to share past work that we have completed.  This means that with your prior consent, we may share your photographs (and names) on the following: Our website, Blog, Facebook page, Instagram Page.  We may also use your images in our portfolio.

Log Data - Like many site operators, we collect information that your browser send whenever you visit my site (“Log Data’).

This log data may include information such as your computer’s internal protocol (“IP”), address, browser type, browser version, the pages of our site that you visit, the time and date of your visit, the time spent on those pages and other statistics.

In addition, we may use other 3rd party services such as google analytics that collect, moniter and analyse this.

Communications - With your prior consent, we may use your Personal Information to contact you with newsletters, marketing or promotional materials and other information.

Cookies - Cookies are files with small amounts of data, which may include an anonymous unique identifier.  Cookies are sent to your browser from a website and stored on your computer’s hard drive.

Like many sites, we use “cookies” to collect information.  You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent.  However, if you do not accept cookies, you may not be able to use some portions of my site.

Security - The security of your personal information is important to us, but remember that no method of transmission over the internet or method of electronic storage, is 100% secure.  While we strive to use commercially acceptable means to protect your personal information, we cannot guarantee it’s absolute security.

The Personal Information that is held by us physically is held securely (locked cupboard) and electronic data is password protected.

We hold your personal information indefinitely, this is because you may wish to use our services in the future at different times during your life and you may experience loss of your images due to an incident outside of your control such as computer breakdown , fire or flood.  By holding the images we can re-supply them to you (subject to retrieval costs applicable at the time).  You can request that your Personal Information is deleted from our records (including photographs) at any time in writing.

 Changes to this privacy policy - This privacy policy is effective as of 25th May 2018 and will remain in effect except with respect to any changes in it’s provisions in the future, which will be in effect immediately after being posted to this page.

We reserve the right to update or change our Privacy Policy at any time and you should check this Privacy Policy periodically.  Your continued used of the service after we post any modifications the Privacy Policy on this page will constitute your acknowledgement of the modifications and you consent to abide and be bound by the modified Privacy Policy.

Subject Access Request - You may, at any time request information of all data held by Fothergill Photography about you.  This information will be provided to you within one calendar month of your request.  If requests are made by you regularly or are deemed excessive, a charge may be applied.

Complaints - If you feel there is a problem with the way we are handling your data, you are able to raise your concern with the ICO (Information Comissioner's Office).
